In giving an account of the Roman law'' of security, I did not notice, at the proper place, the improvements which took place in the Fiducia The gradual progress of the Fiducia, from a bare right to compel the debtor to make satisfaction, to its latest improvements, when it ripened into some thing like the mortgage of the English law, or our own conditional sale, is not less interesting than the development of the kind of securities which I have been hitherto considering.
