This tract was followed in the same year by two others - one entitled Evi dence on the Operation of the Code, and the other Codification of the Common Law.

From this time to 1855 he was constantly watching and urging forward the completion of the Code in this state, and its adoption in other states. In the session of 1853 he procured the whole Code of Civil Procedure, with slight changes, to be reported for passage by a committee of the assembly, and in like manner, during the session of 1855, the whole Code of Criminal Procedure. In January, 1854, he drew a memorial to the Legislature in favor of the passage of a law to admit the testimony of parties to actions. In March, 1855, he delivered an address to the graduating class of the law school in the University of Albany, in which he endeav ored to enforce the necessity of reforms in the law. Soon after this address a bill was introduced into the Legislature to reorganize the Code Commission, making him one of the Code Commissioners. This bill was sharply opposed, and finally defeated. During the same year he published Law Reform Tract No. 4, on The Competency of Parties as Witnesses for Themselves; and at the beginning of the following year, in January, 1856, Law Reform Tract No. 5, being A Short Manual of Pleading under the Code.
