Slavery as a legal institution came to an end in the United States on the eighteenth of December, eighteen hundred and sixty-five, when Secretary Seward formally an nounced that the thirteenth amendment had been properly ratified by the necessary number of states, and was there fore regularly in force.(l) The constitutional provision, that two-fifths of the slave population should be counted when the number of representatives in Congress should be determined, was no longer effective, for the entire col ored populace must now be considered. The fact that the entire South would be entitled to an increase of member ship in the national House of Representatives was a bit ter proposition to the northerners, and from the beginning of the session the thirty-ninth Congress did little but discuss schemes for changing the basis of apportionment. Many theories were advanced as to the comparative status of the rebellious states; but the one finding the most favor was that the resistance of the South to the consti tution and the laws of the Union, had deprived them of the privilege of enjoying all federal law; Congress could, therefore, reconstruct these states as it pleased, and.
